Elizondo v. California Department of Transportation

Plaintiff Rachel A. Elizondo won a jury verdict of $605,000 on her employment discrimination and retaliation claims against Defendant Department of Transportation (aka CalTrans). Since Rachel was the prevailing party in the case, the trial court awarded over $700,000 in attorney fees for her counsel, John A. Shepardson, and over $117,000 in costs. Seventy-eight percent of the fees and costs recovered from CalTrans were paid to Rachel. Rachel contended the trial court abused its discretion by denying her attorney his Bay Area market rates. The appellate court agreed with her. The case has ordered remanded back to the trial court for further consideration.
